A. All tariff charges are due and payable in United States currency. Failure to pay invoices when due shall place the vessel, its owners or agents or the user of the port facilities upon a delinquent list. A vessel whose owner or agents have been placed on the delinquent list shall not be allowed to utilize the port facilities until all past-due balances and late charges have been paid in full. When a vessel has been placed on the delinquent list, the past-due balance shall accrue a late charge at the rate of eighteen (18) percent per annum on the unpaid balance and any applicable penalties.

B. No vessel may leave the port before payment of all tariff charges incurred by that vessel, and such cargo as was discharged from or loaded upon that vessel, has been tendered to the port director, or such alternative arrangements as are satisfactory to the port director have been made.

C. An owner, shipper, consignee or agent for cargo discharged from or loaded upon a vessel shall pay the tariff charges incurred with respect to that cargo. Payment shall be made before such cargo leaves the port. [Ord. 17-11 § 2; Ord. 01-18 § 3. Formerly 14.02.055.]
