A. If a bidder or offeror who otherwise would have been awarded a contract is found nonresponsive, a written determination of nonresponsiveness, setting forth the basis of the finding, shall be prepared by the purchasing agent and presented to the bidder or offeror within three (3) business days.

B. The unreasonable failure of a bidder or offeror to supply information in connection with an inquiry within three (3) business days of notice by the purchasing agent may be grounds for a determination of nonresponsiveness. A copy of the determination shall be sent promptly to the nonresponsive bidder or offeror. The final determination shall be made part of the contract file and be made a public record.
