A. Within ten (10) business days after the close of the record on appeal, the city clerk, or hearing officer, shall issue a written determination stating which of the records that are the subject of the appeal will be disclosed and which records will not be disclosed. The written determination must include:

1. A brief statement for the denial to include the specific statute, regulation or court decision that is the basis for the denial;

2. Notice that this determination is the final agency decision and that, as provided by AS 40.25.124, the requester may obtain judicial review of the denial by appealing the denial to the Superior Court.

B. The city clerk or hearing officer may extend the ten- (10-) business-day period not to exceed thirty (30) business days upon the written request from the requester, or by sending a written notice to the requester within the initial ten- (10-) business-day time period. [Ord. 16-10 § 2.]
